Layoffs in Estonia: the real<\/i> costs founders need to plan for<\/b><\/span><\/h1>\n

Letting someone go is never easy. But in Estonia, it\u2019s not just about paperwork \u2014 layoffs come with real financial obligations<\/b> you need to plan for. Let\u2019s break them down clearly so you can avoid surprise bills and keep your cash flow predictable.<\/p>\n

 <\/p>\n

Employer obligations when laying off an employee<\/b><\/span><\/h2>\n

When you terminate employment after the trial period (which normally lasts four months), here\u2019s what you must pay:<\/p>\n

    \n
  • Final salary<\/b> for all days worked<\/li>\n
  • Unused vacation compensation<\/b><\/li>\n
  • Statutory severance<\/b> \u2014 one month\u2019s average pay according to law<\/li>\n<\/ul>\n

    From the employer\u2019s perspective, salary and vacation pay come with 33% social tax and 0.8% unemployment insurance on the gross salary, while severance pay comes with only the 33% social tax.<\/p>\n

     <\/p>\n

    When laying off employees, it is also important to keep in mind the notice periods required by law.<\/span><\/h3>\n\n\n\n\n\n\n\n

    If you fail to give enough notice, you pay in lieu of notice \u2014 essentially, the employee\u2019s average wages for the missing days, taxed like normal salary. Additionally, all payments must be made no later than the last working day. If you delay, the employee can demand interest at ECB rates on unpaid amounts.<\/p>\n

    NB!<\/b> You must declare and pay all tax obligations by the 10th of the month following the month in which you make the final salary and severance payments to the employee. Unlike regular salaries, these obligations cannot be spread over several months.<\/p>\n

    Departure gifts<\/b><\/span><\/h2>\n

    Giving the departing employee a laptop or phone as a thank-you? It\u2019s a fringe benefit<\/b>. The company pays:<\/p>\n

    • Income tax:<\/b> 22\/78 of the gift\u2019s value<\/li>\n
    • Social tax:<\/b> 33% of the gift\u2019s gross value<\/li>\n<\/ul>\n

      Example:<\/b><\/p>\n

        \n
      • Laptop market value \u20ac400.<\/li>\n
      • Income tax: \u20ac400 \u00d7 22\/78 = \u20ac112.82<\/li>\n
      • Social tax: (\u20ac400 + \u20ac112.82) \u00d7 33% = \u20ac169.23<\/li>\n
      • Total taxes = \u20ac282.05 paid by the company on top of giving away the laptop.<\/li>\n<\/ul>\n

         <\/p>\n

        Non-compete payments after termination<\/b><\/span><\/h2>\n

        If you pay a post-employment non-compete<\/b>, each monthly payment is taxed like salary:<\/p>\n

          \n
        • Social tax 33%<\/li>\n
        • Unemployment insurance 0.8%<\/li>\n<\/ul>\n

          Example:<\/b> Six months of \u20ac1,000\/month (gross payment) \u2192 each month, \u20ac1,000 + \u20ac330 social tax + \u20ac8 unemployment contributions = \u20ac1,338 total.<\/p>\n
